1. Introduction
These Terms and Conditions govern access to and use of Casino de Charlevoix, a land-based gaming and entertainment facility operated within the Hôtel-Casino de Charlevoix complex in La Malbaie, Québec. The facility operates under the authority of Loto-Québec, the provincial Crown corporation regulating gaming in Québec. Entry or participation in any gaming activity constitutes agreement to comply with these Terms, all gaming rules, and applicable laws of Québec and Canada.
2. Eligibility and Access Requirements
2.1. Minimum Age
Only individuals aged 18 years or older may enter the Casino de Charlevoix. Valid government-issued photo identification may be requested at any time. Individuals unable to provide proof of age will be refused entry or required to leave.
2.2. Right of Admission
Casino de Charlevoix reserves the right to refuse entry or remove any individual at its discretion, including but not limited to individuals who:
– Do not meet age requirements
– Appear intoxicated or under the influence
– Engage in disruptive, abusive, or unlawful behaviour
– Are subject to exclusion programs, voluntary or involuntary
– Violate any provision of these Terms and Conditions
2.3. Dress Code and Conduct
Appropriate attire and behaviour are required on the premises. Dress code standards may be established and enforced as needed. Behaviour disrupting other patrons, impacting gaming operations, or threatening safety and security is prohibited.
3. Gaming Rules and Procedures
3.1. General Gaming Conditions
All gaming is subject to official rules established by Loto-Québec as posted at each gaming station or table. In case of dispute regarding game results, payouts, or procedures, the determination of gaming supervisors and management prevails.
3.2. Promotional Offers and Gaming Credits
Promotional gaming credits, complimentary play, or incentives may be offered subject to:
– Defined eligibility criteria (such as group participation or loyalty status)
– Daily or per-visit limits
– Expiry dates
– Restrictions on transfer or redemption
For group or coach operator programs, gaming credit offers are limited to one per eligible individual per day and are not combinable unless expressly allowed.
3.3. Winnings and Payouts
Winnings are subject to verification and applicable Canadian tax reporting requirements. Payment may be withheld pending identity verification, dispute resolution, or regulatory compliance. Each patron is responsible for managing their own tax obligations related to gaming winnings.
4. Reservations and Group Visits
4.1. Reservation Requirements
Some services and experiences require advance reservation. Reservations may be subject to availability, group size requirements, and cancellation policies. Casino de Charlevoix reserves the right to modify or cancel reservations due to operational needs, force majeure, or circumstances beyond its control.
4.2. Group and Tour Packages
Group visits, including those via third-party tour operators, are subject to the conditions of each package. Package elements such as gaming credits, meal vouchers, and other benefits are non-transferable and contingent on the terms at the time of booking.
5. Hotel and Resort Services
5.1. Separate Terms for Accommodation
Hotel stays within the Hôtel-Casino de Charlevoix complex, including Fairmont Le Manoir Richelieu, are subject to terms and conditions of the respective hotel operator. These include booking policies, cancellation terms, resort fees, and other charges. Patrons booking casino packages that include accommodation must review and accept the hotel’s terms in addition to the casino Terms and Conditions.
5.2. Resort Experience Fees
Some packages or accommodations are subject to resort fees or mandatory charges, disclosed at booking and payable in accordance with hotel billing policies.
6. Responsible Gaming and Self-Exclusion
6.1. Responsible Gaming
Resources and information on responsible gaming, self-assessment, and support services are available on site and through Loto-Québec’s official channels.
6.2. Voluntary and Involuntary Exclusion
Voluntary self-exclusion is available by contacting customer service or following Loto-Québec procedures. Persons under exclusion, voluntary or involuntary, are not permitted to enter the casino. Violation of an exclusion order may result in removal, forfeiture of winnings, or legal action.
7. Privacy and Data Collection
7.1. Personal Information Collection and Use
Personal information, including name, date of birth, contact details, and identification documents, may be collected for eligibility verification, gaming administration, regulatory compliance, and communication. Information is handled in accordance with Québec privacy legislation and Loto-Québec privacy policies.
7.2. Surveillance and Security
The premises are monitored by video surveillance and other security systems for the safety of patrons, staff, and assets and in compliance with gaming regulations. Entry to the casino constitutes consent to such monitoring.
8. Limitation of Liability
8.1. Use of Premises at Own Risk
Patrons use the premises and participate in gaming activities at their own risk. Casino de Charlevoix accepts no liability for loss, injury, or damage resulting from participation in gaming, except where such liability cannot be limited by law.
8.2. Lost or Stolen Property
Casino de Charlevoix is not liable for lost, stolen, or damaged personal property. Patrons are advised to secure valuables and notify security personnel of any loss immediately.
9. Amendments and Governing Law
9.1. Changes to Terms
Casino de Charlevoix may amend these Terms and Conditions at any time without prior notice. Amendments are effective immediately upon posting or communication. Continued use of the facility constitutes acceptance of revised terms.
9.2. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Québec and the applicable federal laws of Canada. Any disputes are subject to the exclusive jurisdiction of the courts of Québec.
